The Timeshare Consumer Association Ltd [TCA Ltd] was a once a great niche organisation which delivered free advice to many desperate consumers, all having a need to obtain independent advice regarding the lawfulness of the products they bought. The products in question are Timeshares and memberships into Long Term Holiday Clubs, sold to them in Europe and the Americas and as “investments”.
In the past, the TCA Ltd was directed by Alexander (Sandy) Grey and until his untimely death in 2013. Prior to his death, Sandy (aged 72) and when leaving his local Pub was set about by a group of thugs, who left his semi-unconscious bleeding and distressed and after a beating. Later he was admitted to hospital and suffered from Motor neurone disease and died leaving a grieving family and many sad friends.
After the obvious collapse of the Timeshare Consumer Association (as it was) a need existed and to re-energize it to continue the Work, Sandy Grey had begun. As Stephen Boyd admired the work Sandy did and equally knew the need for independent advice was required, he believed that the organisation required re-energised, so the needs of the many were fulfilled. In pursuit of that goal, Mr. Boyd invited David Cox to head up a new Timeshare Consumer Association movement which I shall refer to as - TCA (2).
A website was created, funding was obtained, phone lines installed and the TCA (2) was launched. When launched the TCA (2) website came to the attention of TATOC [an alleged consumer Association] however, funded by the Timeshare industry by way of financial donations. The simple fact was that TATOC and its financial supporters had a need to close down TCA (2) as it infringed upon their activities and the advice they disseminated which in essence was to return complaining consumers back to the Timeshare Resort and for industry advice, resulting in independent advice being denied them.
The battle between TCA (2) raged and involved letter exchanges between Solicitors. Upon the TCA (2) creation and launch, Mr Stephen Boyd Resigned and the Company was controlled by David Cox who was then and still is an unpaid servant of the Association. When resigned Mr Boyd turned his mind back and continued to serve the firm of Solicitors he was employed by “Apelt Cater” which later merged with Lynda Meyers. With the Assistance of David Cox, the TCA (2) grow and became popular. Consumers having a need for legal assistance TCA (2) created Tess [Timeshare exist and Support Service] Ltd so as to assist consumers with legal services which could and has obtained release from 000, s of erroneous timeshare contracts and at low cost.
In January 2015 TCA (2) was approached and to assist over 800 consumers by “Sell My Timeshare” who alleged they operated in compliance with the Timeshare regulations. They asserted they had 800 consumers in need of an effective relinquishment service, claiming the timeshare industry had adopted the position that the reselling consumer’s timeshare was not permitted.
TESS via the TCA (2) accepted a low-cost commission decided to help the consumers on condition that service was paid for by Sell My Timeshare. As Monster Travel was not involved in Timeshare [at the time] no consideration was necessary to evaluate that enterprise. From January 2016 to October the same year TESS Under the Direction of David Cox boomed. In October a circumventing event occurred in that TATOC elevated its attack against the TCA (2) and TESS.
Part of that Attack asserted that TESS is a “cold caller” implying that TESS and its owners were scurrilous obtaining clients by were “unsolicited approaches” [Cold Calls].
The published allegation was false, defamatory and was being perpetrated to cancel out the effects TCA (2) was having against TATOC sponsors. If the allegation were to remain in the public domain then the effects would cause damage and eventual distrust thus, the allegation had to be confronted, immediately and head on.
That said, money was required and to issue proceeding against a well funded TATOC should they refuse to remove the allegation from public view, which they did. Thus, a letter before action was sent, However, TATOC again refused to remove it. Accordingly, TESS needed to seek protection from the courts which required an injection of funding which could only come by way of a “fire sale” of assets, the biggest being the TCA (2) website itself. Thus, the TCA (2) invited offers and accepted the highest offer and sold it and the Timeshare Talk website to a Mark Rowe company called TOLMEX Ltd and on condition, it was only used for altruist purposes.
Because of the unproven and defamatory allegations, the sums received were delivery to Mr Boyd [now a partner in Athena Solicitors] and to fight and rid the timeshare world of TATOC. TCA (2) was successful, proved its case and in 2017 won monumental damages and costs which TATOC could not afford to pay thus, TATOC went bankrupt, as it was unable to pay its debt to TESS when due. Therefore, TCA (2) and TESS achieved the goal, it set for its-self.
However that is not the end of the story, in position of TCA’s website and it being reviled in July 2016 that Mark Rowe and his plethora of website including “Sell my Timeshare”, “Monster Travel”, “Monster Credits”, “Timeshare Lawyer”, “ABC Lawyers”, ”Staycations” , “Jive Hippo”, “Monster Rewards”, “The Timeshare Consumer Association”, “Timeshare Talk” and others were mis-selling products, Both TCA (2) [now named long-term holiday products Ltd [LTHPA] and TESS forged a further relationship with Mr Boyd [Athena Law] took action and to preserve the rights of 000,s of Timeshare consumers. After considerable investigation, both Tess and Athena launched a multi-million civil action against the Companies which assisted in the sale of “Monster Credits”.
TESS and LTHPA had a duty to and did inform the consumer of the “scams” being perpetrated and in doing so advised many others including action fraud, the police trading standards the timeshare industry.
TESS produced a report and distributed 2,000 copies to consumers all over Europe.
TESS then with Athena courted the BBC and others so that the Monster “Scam” could be reviled to the world which it was.
In rebuttal, Mark Rowe and TOLMEX Ltd Via its TCA (2) website proceeded to make “wild”, “unkempt” and false allegations and against Athena Law asserting that Athena Law was being investigated and for breaches in “data protection” which was a gross falsehood and a perversion of the truth.
Exposed and being a “sham” the heat was turned up on the Monster Credits and to date over 700 cases have been launched which could deliver millions in damages and for consumers [70 cases won to date]. TESS believes a monumental fraud has been and still is being committed and by companies owned by Mark Rowe and now with the assistance of TCA website, which has been exposed by the Daily Mirror.
Athena Law now have time to set the record straight, stepped up to the mark and has now issued Defamation proceeding and against Mark Rowe the owners of the TCA (2) website seeking protection from the courts and extensive undisclosed damages for defamation
So its TATOC 2, however, the parties are Athena-V- Mark Rowe and others and Athena are as bullish as TESS was.
The reality is Athena Law is not being investigated, never was investigated and the allegation was a falsehood and designed to damage the reputation of a regulated Solicitor and his firm.
Without revealing too much at this stage, proof now exists and regarding the owner of the TCA website. The allegation they made was malicious, a falsehood and an engineered corporate malice. Accordingly, Athena is confidence that an injunction and substantial damages will be awarded and because Mark Rowe and his merry band of ex-timeshare salesmen besmudged a regulated Lawyers.
So, the battle is a Regulated Lawyer-v-an ex Timeshare Salesmen posing as Lawyer. No doubt if ABC Lawyers are worth any salt they will employ themselves to defend the action. That said as they are Fake Lawyers I dare say they will seek the assistance of a regulated one.
